Terms of service

These Terms of Use (hereinafter referred to as "Terms") define the conditions for using the online shop (hereinafter referred to as "Service") provided by WAKON ARCS Co., Ltd. (hereinafter referred to as "Company") on this website. All registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

  1. These Terms apply to all relationships between Users and the Company regarding the use of the Service.

  2. The Company may reject a registration application if:
    1. False information was provided in the registration application.
    2. The applicant has previously violated these Terms.
    3. The Company deems the registration inappropriate for any other reason.

Article 3 (Management of User ID and Password)

  1. Users are responsible for managing their User ID and password for the Service.
  2. Users must not transfer, lend, or share their User ID and password with any third party. If the User ID and password match the registered information, the Company will consider it as use by the registered User.
  3. The Company is not liable for any damages caused by third-party use of the User ID and password unless there was intentional or gross negligence on the part of the Company.

Article 4 (Sales Contracts)

  1. A sales contract is formed when the User applies for a purchase and the Company accepts the application. Ownership of the product is transferred to the User when the Company hands the product over to the shipping carrier.
  2. The Company may terminate the sales contract without prior notice if the User:
    1. Violates these Terms.
    2. The product cannot be delivered due to an unknown delivery address or long-term absence.
    3. The trust relationship between the Company and the User is deemed damaged.
  3. Payment methods, shipping methods, order cancellation, and return policies shall be determined by the Company's separate provisions.

Article 5 (Intellectual Property Rights)

All copyrights and other intellectual property rights related to product images and other content (hereinafter referred to as "Content") provided by the Service belong to the Company or the rightful owner. Users shall not reproduce, reprint, modify, or otherwise use the Content without permission.

Article 6 (Prohibited Conduct)

Users are prohibited from engaging in the following acts when using the Service:

  1. Acts that violate laws or public order and morals.
  2. Acts related to criminal activities.
  3. Infringing on copyrights, trademark rights, or other intellectual property rights contained in the Service.
  4. Destroying or interfering with the Company's servers or networks.
  5. Commercial use of information obtained through the Service.
  6. Acts that may interfere with the Company's services.
  7. Unauthorized access or attempts thereof.

  9. Impersonating other Users.

Article 7 (Suspension of Service)

  1. The Company may suspend or interrupt the Service without prior notice to Users if:
    1. Maintenance or updates are required for the system related to the Service.
    2. Service provision becomes difficult due to force majeure, such as earthquakes, lightning, fire, power outages, or natural disasters.
    3. Computers or communication lines are disrupted due to an accident.
    4. The Company determines that providing the Service is difficult for any other reason.
  2. The Company is not responsible for any disadvantages or damages suffered by Users or third parties due to the suspension or interruption of the Service.

Article 8 (Usage Restrictions and Deregistration)

  1. The Company may restrict all or part of the use of the Service or deregister a User without prior notice if the User:
    1. Violates any of the provisions of these Terms.
    2. Has provided false information during registration.
    3. The registered credit card is suspended.
    4. Fails to fulfill payment obligations.
    5. Fails to respond to communications from the Company for a certain period.
    6. Has not used the Service for a certain period since the last use.
    7. The Company deems the use of the Service inappropriate for any other reason.
  2. The Company is not liable for any damages resulting from actions taken under this article.

Article 9 (Withdrawal)

Users may withdraw from the Service by following the prescribed withdrawal procedures.

Article 10 (Disclaimer and Limitation of Liability)

  1. The Company does not guarantee that the Service is free from defects, including safety, reliability, accuracy, completeness, security, errors, bugs, and infringements of rights.
  2. The Company is not liable for any damages incurred by Users from using the Service. However, if the contract between the Company and the User falls under the Consumer Contract Act, this disclaimer does not apply. In such cases, the Company will not be responsible for damages arising from special circumstances unless caused by gross negligence.
  3. The Company is not responsible for disputes between Users or between Users and third parties related to the Service.

Article 11 (Changes to the Service)

The Company may change or discontinue the Service without prior notice to Users. The Company is not liable for any damages caused to Users as a result.

Article 12 (Changes to the Terms)

The Company may amend these Terms at any time without notifying Users. By continuing to use the Service after changes to the Terms, Users are considered to have agreed to the revised Terms.

Article 14 (Notifications and Communication)

Notifications and communications between Users and the Company shall be conducted in the manner prescribed by the Company. Unless otherwise notified, the Company will consider the currently registered contact information to be valid and send notifications and communications to that address, which will be deemed delivered upon dispatch.

Article 15 (Prohibition of Assignment of Rights and Obligations)

Users may not transfer or pledge their contractual status, rights, or obligations under these Terms to a third party without the prior written consent of the Company.

Article 16 (Governing Law and Jurisdiction)

  1. The interpretation of these Terms shall be governed by Japanese law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.
  2. Any disputes regarding the Service will be subject to the exclusive jurisdiction of the court with jurisdiction over the location of the Company's headquarters.
